Multi-Industry Response to European Ruling on EU-U.S. Privacy Shield

On July 16, 2020 the European Court of Justice ruled that the EU-U.S. Privacy Shield is no longer a valid mechanism for transferring personal data from the EU to the U.S. Fortunately, the ruling also upheld the continued use of standard contractual clauses.

The U.S. Chamber of Commerce in Washington D.C. issued a press release after the ruling was announced and in response to the ruling submitted a cross-industry letter to the U.S. Department of Commerce encouraging them to work with their EU counterparts to swiftly develop a new suitable mechanism for cross-border data transfers. The letter was signed by multiple European AmChams including AmCham The Netherlands and several other assocations. A copy of the letter is available here.
