30% Rule: Letter to State Secretary for Finance Menno Snel

May 25, 2018 - Today, in a letter to State Secretary for Finance Menno Snel, AmCham and the German Chamber of Commerce (Duits-Nederlandse Handelskamer) have jointly pleaded for the preservation of the 30% Rule, or at least for a transitional arrangement for those currently benefiting from the fiscal facility. Betreft: verzoek handhaving 30%-regeling / instelling overgangsregeling

Hooggeachte heer Snel,

Deze brief schrijven wij u naar aanleiding van de “Kabinetsreactie evaluatie 30%-regeling” van 20 april jl., waarin u de evaluatie toelicht van de Nederlandse overheid met betrekking tot het belastingvoordeel voor niet-permanente werknemers uit het buitenland die in Nederland wonen en werken.

Uw brief volgt op het Dialogic-rapport dat op 1 juni 2017 werd gepubliceerd en op de meer dan twintig reacties van verschillende belangengroepen die vervolgens zijn verstrekt op verzoek van de Tweede Kamer.

Het Dialogic-rapport concludeert dat de 30% -regeling zowel efficiënt als effectief is. Tweederde van de respondenten geeft aan de 30% -regeling te willen behouden of te verbeteren. Zij benadrukken in het bijzonder het belang van de regeling voor het Nederlandse innovatie- en investeringsklimaat en de internationale wetenschappelijke positie van Nederland.

Gegeven deze bevindingen, die de leden van de American Chamber of Commerce in the Netherlands en de Duits-Nederlandse Handelskamer volledig onderschrijven, zijn wij zeer bezorgd over uw aankondiging dat de 30%-regeling vanaf 1 januari 2019 toegepast zal worden voor een ingekorte periode van vijf jaar – nota bene zonder een overgangsregeling voor belastingbetalers die op dit moment gebruikmaken van de 30%-regeling.

Een overheid die fors extra belasting heft ten laste van tijdelijke werknemers die grote waarde toevoegen aan de Nederlandse economie en / of aan verdere wetenschappelijke vooruitgang, schaadt de reputatie van Nederland als aantrekkelijke vestigingslocatie voor internationale bedrijvigheid en innovatie. Eerder aangekondigde belastingmaatregelen indachtig die reeds van invloed zijn op het Nederlandse vestigingsklimaat, pleiten wij voor een heroverweging die leidt tot instandhouding van de 30%-regeling, of tenminste een overgangsregeling ten behoeve van diegenen die reeds gebruikmaken van deze regeling.

Subject: Request for Preservation of 30% Rule / Transitional Arrangement

Honorable Mr. Snel,

We write to you in regard to your letter “Kabinetsreactie evaluatie 30%-regeling” of April 20, wherein you provide the Dutch government’s evaluation of the tax break for expatriated non-permanent employees living and working in the Netherlands (‘30% Rule’).

Your letter is subsequent to the Dialogic report commissioned by the Ministry of Finance and published on June 1, 2017 and to more than twenty reactions provided by various business and non-business interest groups in response to a request by Parliament late Summer 2017.

The Dialogic report concludes that the 30% Rule is both efficient and effective. Two thirds of the respondents to the request by Parliament prefer to maintain or improve the 30% Rule, emphasizing the importance of the tax break for the Dutch innovation and investment climate, as well as for the international scientific position of the Netherlands.

In view of these findings, which our members strongly endorse, we are very concerned about your announcement that as of January 1, 2019 the 30% Rule will be applicable for a reduced period of 5 years without any transitional provisions for existing tax payers benefiting from the 30% Rule.

A government that levies heavy additional taxes on temporary employees who add great value to the Dutch economy and/or who further scientific progress, damages the reputation of the Netherlands as a preferred destination for international business and innovation. In view of previously announced tax measures that are already affecting the Dutch investment climate, we advocate for a reconsideration that leads to preservation of the 30% Rule, or at least a transitional arrangement for those currently benefiting from the 30% Rule.
